Probation violation brings prison term in criminal sexual conduct case




After serving one year of a five-year probation, Timothy J. Thornton II, 21, was remanded to the state correctional facility at St. Cloud on September 24, 2009, where he will serve 48 months. He had pled guilty a year before on one count of 3rd degree criminal sexual conduct with a victim between the ages of 13 and 15 who was more than 24 months younger than him.

Probation Officer Scott Johnson reported September 10 that Thornton, who had a Minneapolis address by that time, had violated the terms of his parole and recommended that the judge vacate Thornton’s stay of imposition. Johnson’s reasons were failure to cooperate in sex offender treatment and failure to report to probation as directed.

The conditions of probation had been that Thornton complete sex offender treatment and prescribed aftercare, complete a chemical dependency evaluation and comply with recommendations, have no association in any form with females under 18, and have no contact with the victim.

According to court documents, the victim, who was 14 at the time, met Thornton at a school dance the last week of school in June 2008. She went to Thornton’s house a few days later, where he supplied her with alcohol and had sexual contact with her. He was 20 at the time and knew her age.

Thornton was originally charged with four felony counts of criminal sexual conduct with penetration for that incident and three others involving the victim over the next several weeks. He was also charged with furnishing alcohol to a person under age 21, a gross misdemeanor, but all but one count of criminal sexual conduct were dismissed.

The maximum sentence was 15 years in prison and a $30,000 fine. Thornton’s 48 months of confinement will be followed by five years of conditional release, the maximum term of supervised release, equal to 1/3 of the total executed sentence. He was also required to pay $168 in fines, surcharges, and fees. Thornton was given 87 days credit for time served through September 23, 2009.
