On October 5, 2009, Assistant County Attorney Molly Hicken moved to dismiss charges against Dennis Neitzke of Grand Marais with the condition that no same or similar incidents take place within one year.
Neitzke had been scheduled to appear in court on October 7 to face a misdemeanor domestic assault charge following an altercation with his daughter-in-law at his home on July 19, 2009.
Neitzke admitted that he had been concerned about the welfare of his six-month-old grandchild and that he attempted to stop the child’s mother from taking him from the house.
Reached by telephone, County Attorney Tim Scannell explained that the charges were dropped “based on the fact that we do not have adequate evidence to go forward with the charges.”
Following the incident, Neitzke’s son and daughter-in-law requested an order for protection. The order for protection was also dismissed on October 6.
