Former Grand Marais man sentenced for assault




An assault case taken to trial by jury ended with a guilty verdict on July 27, 2012. The jury found Brian Christopher Fairbanks, 29, Deer River, MN, guilty on three counts—felony assault in the 3rd degree; misdemeanor domestic assault and obstructing the legal process. Fairbanks was sentenced on September 18, 2012.

Imposition of felony assault charges resulting from an August 25, 2011 incident were stayed for five years of probation with numerous conditions. If probation is successfully completed, the conviction will be considered a misdemeanor.

The conditions of probation are that Fairbanks must be incarcerated for 90 days, which can be completed on the sentence-to-serve program. He must refrain from use of non-prescribed drugs or any mood altering substances; must have no assaultive or threatening behavior toward anyone; and must complete a domestic abuse intervention program.

For the misdemeanor charges of domestic assault and obstruct legal process, Fairbanks must serve 60 days in jail

Fairbanks was arrested and charged after Cook County Sheriff Deputies were called to his home in Grand Marais on August 25, 2011.
