County to Hold Public Hearing on the Tobacco Ordinance



The county board will hold a public hearing regarding the county’s tobacco ordinance on May 24, 2022. The hearing will take place at 9 a.m. in the commissioner’s room at the courthouse.

The county’s tobacco ordinance is being updated to comply with the State’s Tobacco 21 law. The updates to the ordinance will include provisions to allow the use of sacred tobacco by indigenous people.

Minnesota’s Tobacco 21 law went into effect on August 1, 2020. The law ensures compliance and enforcement of commercial tobaccos sale and e-cigarettes to people 21 and older.

On March 15, 2022, the state passed legislation defining e-cigarettes, and sales and distribution of e-cigarettes to persons under age 21. The legislation also says a town board or governing body may license and regulate electronic delivery devices however, “If they do not, the county board shall license and regulate electronic delivery devises.”

The March 15 statue also defines smoke free restrictions for e-cigarette use, prohibiting the use of e-cigarettes in all public places including government buildings, schools, colleges and vehicles owned, rented or leased by a school district.
