Charges filed for two involved in June rollover fatality




Two young men involved in a vehicle rollover on Pike Lake Road that resulted in the death of 14-year-old Dylan Alexander Richard Marshall of Grand Marais have been charged in the accident. Hearings are scheduled in Cook County next week for both parties.

The accident was reported to the Cook County Sheriff ’s Office by a homeowner near the site of the crash at 5:02 a.m. on June 13, 2013.

The car, a 1999 Chevy Cavalier, not registered to any of the vehicle occupants, was traveling east from Pike Lake toward Grand Marais about a half mile from the intersection with County Road 44 when the driver lost control of the vehicle. Marshall, who was apparently riding in the back seat, was ejected from the vehicle. He was pronounced dead at the scene. Marshall was not wearing a seat belt.

The other two occupants, Thomas Adam Stacy, 18, and the 16-year-old driver were wearing seatbelts and suffered non-life threatening injuries. One was transported by Cook County Ambulance to Cook County North Shore Hospital and the other traveled to the hospital by his own means. They were both treated and released.

According to law enforcement records, the accident occurred after a group of seven people under the age of 21 had gathered at a campsite off the Cascade River Road the night before, June 12. According to a number of minor witnesses, including the defendants, juveniles at the campsite were drinking. The minors left the campsite between 1 – 2 a.m. to spend the night at the nearby residence of one of the juveniles. Sometime before 5 a.m. on June 13, the parties involved in the car accident left the residence while others were sleeping.

The juvenile driver will appear before Judge Michael Cuzzo on Sept. 23 at 10:45 a.m. He faces 11 charges, including one felony charge of criminal vehicular homicide or operation (operate motor vehicle in grossly negligent manner); two felony charges of criminal vehicular homicide with negligence (under the influence of alcohol/controlled substance); one felony charge of theft/take motor vehicle with no owner consent; three gross misdemeanor charges of criminal vehicular homicide or operation; and four gross misdemeanor charges of furnishing liquor to minors.

The Sept. 23 hearing is scheduled to be an admit/deny hearing. A petition to certify the driver to stand trial as an adult is also to be considered.

According to court documents, because the juvenile was over 16 at the time of the offense and because the offense is considered a severity level 8 offense under Minnesota Sentencing Guidelines, Special Assistant Cook County Attorney Laura M. Auron of Lake County is requesting that the matter be decided in adult court.

Thomas Stacy is scheduled to make his first court appearance in Cook County court at 9 a.m. on September 24. Stacy has been charged with furnishing alcohol to an underage person, a gross misdemeanor, an offense that could result in one-year incarceration and/or a $3,000 fine.
